The
following information is posted inaccordance with the Labour Relations
Board.
Amended Notice to Employer and Employees
On
June 25, 2003, the Calgary Board of Education Staff Association
("the Association") filed a complaint to the board under
section 60(3) of the Labour Relations Code.
The
Association alleges the Calgary School District No. 19 breached
section 60(3) of the Code by announcing it was reducing the hours
of work for the lunchroom supervisors. This announcement occurred
after the parties ratification of a collective agreement.
On
July 15, 2003, the Association made a further complaint to the
Board under Section 16(12). The Association alleges the employer
interfered with representation of employees by the trade union
as they ignored a June 1997 memorandum of settlement that recognized
the union's bargaining rights in issues such as reduction of funding
for lunch room programs.
The
Board had scheduled a hearing. The hearing dates are revised as
follows:

of 17th June 2003, the monies in the Staff Development fund is
depleted. No more applications will be processed until September
2003.
Please
note that from September 2003, each permanent staff member may
be eligible for $400 in each school year.

As
we are all well aware this is budget time within the Calgary Board
of Education and because of this we must address some crucial
issues for Support Staff.
- Volunteers - Article 6 Clause 6.3 states
"Volunteers will
not be used to replace or reduce the FTE of permanent employees".
If you have a reduced FTE or a position that has been declared
redundant it is imperative that Article 6 is followed. Please
contact the Staff Association Office if you feel that Volunteers
are being used inappropriately or you feel that they will be.
Example: Library Assistants.
- School
Opening - C.B.E. Administration stresses the importance
of submitting time sheets when you are called in early. Remember
there is no such thing as "lieu time" for straight
time or start up. "Lieu Time" can be a negotiated
(mutually agreed) method of payment for overtime.
- WorkLoad
- failed to be addressed in Negotiations, however, a Committee
from Mutual Interest will be working on this issue.
In
the meantime, the C.B.E. agrees with Staff Association, that our
members should not work for free and should be paid the appropriate
rate of pay for the work that is done. Example - If you are working
as a Lunchroom Supervisor (A) you should be paid an (A). If you
are working as a School Assistant (B) you should be paid as a
(B).
If
Staff Association, Alberta Teachers Association, CUPE, Trades,
Exempt, continue to do the same amount of work with fewer people,
how will we ever convince anyone, let alone the Province, that
we are underfunded? Working for free only devalues all our worth.
Let's give ourselves and all our fellow C.B.E. employees some
"RESPECT".

This
is an information update regarding some of the specific changes
as a result of the recent settlement of the Staff Association
Contract and the Staff Association Professional Support Staff.
Calgary
Board of Education (CBE) Employees Affected by the STAFF ASSOCIATION
Main Agreement and CBE Employees Affected by the PROFESSIONAL
STAFF ASSOCIATION Agreement.
Salary
Impacts
Effective January 1, 2002, a 3% increase
Effective September 1, 2002, a 3% increase
These
new rates will be reflected on the payroll deposit of May 16,
2003 for all Permanent and Temporary staff association employees.
The
retroactive adjustments, for both Permanent and Temporary staff
will be paid on a separate deposit no later than May 30, 2003.
This retroactive adjustment will be on all applicable earnings
since January 1, 2002.
On
the retroactive pay deposit in addition to normal statutory tax,
CPP and EI deductions, there will be LAPP and Union Dues deducted.
For
Temporary Employees, who are paid Vacation on each pay deposit
there will be an increase from 4% to 6% of their applicable earnings.
This is effective on the payroll deposit of May 16, 2003. There
will be a retroactive adjustment for the Vacation pay on earnings
since March 23, 2003.
Pension
& Union Dues Impacts
The LAPP deduction, for the Retroactive payment will be calculated
at the excess contribution rate of 6.4%, as most individuals have
contributed to the basic pension per pay maximum.
Union
Dues continues to be deducted on the basis of a percentage of
gross earnings as set by the Staff Association.
Benefits
Impacts
With the change to Article 20 - Group Benefits Plan, the collective
agreement was revised to include employees with a .429 FTE to
be eligible to participate in the plan on an optional basis.
The
Human Resources Benefit work unit will be sending letters to eligible
employees by the end of the month which will provide helpful information,
including associated costs, in order to assist employees in making
a decision to join the plan.
The
election of these benefits are being offered to employees, on
a one-time basis, effective on the first day of work in the 2003/04
school year. Participation is optional, however once an employee
has exercised their option, continued participation shall be a
condition of employment as long as the position remains at .429
FTE or higher.
FOR
CBE Employees Affected by the STAFF ASSOCIATION main agreement
ONLY.
Time
Sheets Impacts
Effective the pay deposit of May 16, 2003 Permanent employees
with additional temporary work assignments are eligible to be
paid at the current step of the permanent position in the Grade
of the temporary work assignment.
The
following examples show the impacts to the hourly pay rate for
the temporary assignment;
- Permanent
position is Grade C, Step 8 then if the work assignment is Grade
C, paid at Step 8
- Permanent
position is Grade D, Step 2 then if the work assignment is Grade
C, paid at Step 2
- Permanent
position is Grade C, Step 7 (18.06/hour) and if with a work
assignment is in a position with a higher grade such as Grade
D, the employee would be paid a 2 Step increment based on the
rate which would be at Step 7 (19.37/hour) Retired employees
now working in temporary positions are eligible to be paid at
the Step from which they retired, in the grade of the temporary
position they are working effective pay deposit of May 16, 2003.
The
following examples show the impacts to the hourly pay rate;
- Retired
at Grade E, Step 7 an individual will be paid at Step 7 for
any temporary work assignment for positions of Grade E, D, C,
B and A.
- Retired
at a position Grade C, Step 7 an individual would only be eligible
to be paid at Step 7 for Grade C, B and A.
- Retired
at a position Grade C, Step 7 with a temporary work assignment
in a position of Grade E and above then the pay should be paid
at the greater of Step 1 or two steps higher than pre-retirement
salary rate.
- Retired
at a Step 9 for Grade D and working in a position which doesn't
have a step 9, Grade B or A then should be paid at the maximum
Step of the Grade.For all temporary employees it is important
that employees use the new grid in reporting the hourly rate
on the timesheet. Employees must indicate on the timesheet in
the column "type of work" the position number, grade
and step. If the recent timesheet submission for payment on
May 16, 2003, did not include this information, it will be paid
at step 1 (new grid rate); please contact payroll in order to
adjust the pay to the correct step.

During recent negotiations, the Staff Association negotiating
team not only managed to secure an increase in salary for all
members but they were able to negotiate an increase in the staff
development fund.
Because
of this, and $25,000.00 from the Staff Association which the School
Board will match, we will be able to offer $400 each year to all
permanent support staff. Currently we offer $400 every two years.
The
new amount will begin in September 2003. It should be noted that
any monies you may have left will not be carried forward, everyone
will begin with $400 each September.
